What Will Your Verdict Be?

What I'm posting is not mine. I'm not articulate enough to compose such. But I had this in my possession must be over 20 years. I wish to share this with all especially with my friend Jude. Hope you feeling better after your H-attack. Wow thats scary.....heart attack. Take care mann. Call me and I can help you get back to good shape.

One evening after attending the Theatre, 2 gentlemen walking down the avenue, observed a well-dressed lady walking ahead of them. One of them said to his companion, "I'd give $50 to spend a night with that woman". To their surprise, the young lady overheard the remark and turning around she smiled and said, "I'd take you on that".

She had a neat appearance and a pleasant voice. So after bidding his friend good-night, the man accompanied the young lady to her apartment and they immediately went to bed.

The following morning, the man presented the young lady with $25 as he prepared to leave. She demanded the rest of the money stating, "If you don't give me the $25, I'll sue you for it". The man laughed, saying, "I'd like to see you get it on this grounds".

The next day he was surprised to receive a summon ordering his presence in Court as a Defendant in a law suit. He thus hurried to his lawyer and explained the details of the story. His lawyer said, "She cannot possibly get judgment against you on these grounds. However it will be interesting to see how her case will be presented".

After the usual preliminaries, the lady's lawyer addressed the Court as follows:

"Your Honour, my Client, this young lady, is the owner of a piece of property, a garden spot surrounded by a profuse growth of shrubbery, which property she agreed to rent to the Defendant for the agreed sum of $50. The Defendant took possession of the property, used it extensively for the purpose which it was rented, but upon evacuation of the premises, he paid only $25, being half of the amount agreed upon. The rent was not excessive since the property was restricted. We, therefore ask that judgment to be granted against the Defendant to ensure payment of the balance".

The Defendant's lawyer was impressed and amused at the way his learned opponent had presented the case. His defense therefore was somewhat altered from his original plans.

"Your Honour" he said, "my client agrees that the young lady had a fine piece of property, that he did in fact rent such a property for a time and a degree of pleasure was derived from the occupation, However, my client found a well on the property, around which he placed his own stones, sank a shaft and erected a pump, all labour being performed personally by him. We claim that these improvements to the property was sufficient to offset the unpaid amount and that the Plaintiff was thus compensated for rental of the said property, We therefore ask that judgment be not granted".

The young lady's lawyer then replied, "Your Honour, my client agrees that the Defendant did find a well upon her property and that he did make improvements such as my learned friend has described. However, had the Defendant not been sure that the well existed, he would never had rented the property. Also when evacuating the premises, the Defendant removed the stones, pulled out the shaft and took away the pump with him. In doing so, he not only pulled and dragged his equipment through the shrubbery, but left the hole much larger than it was prior to his occupation, making it easily accessible to children. We therefore ask that judgment be granted".

If you are the Judge, what will your verdict be?

If I were the judge I would have to have an examination of the well and a visitation upon it. How else can I pass any judgement before examining evidence!

Hey Uncle Tony,

Haha! Cool one...Goes to show how important language is!

I bet the judge would have loved to look at the well! How pleasantly surprised he would have been...=)

Hey Tony

If I were the judge (and not knowing what really went on), I would not only make the man pay the remainding $25, I would also order him to arrange for a clean up the 'premises' since dragging his equipment out would have caused a mess. hahaha
